Understanding Expungement in Pennsylvania

The Law Offices of John Della Rocca Nov. 15, 2022

Being either arrested or convicted of a DUI can have many different drawbacks in your life. For starters, it could result in penalties from the court including jail time, large fines, community service, probation, and more. However, there could also be long-lasting consequences like the loss of your job, revocation of your driver’s license or another professional license, a strained relationship with your loved ones, and more. There is an option that might be able to change everything, though.

At The Law Offices of John Della Rocca, I represent those seeking an expungement of their DUI arrest or conviction in Pennsylvania from their record. With over 30 years of experience and a flexible payment plan, I am the criminal defense attorney that you want in your corner.

If you are looking to clear your record in Philadelphia, Delaware County, Montgomery County, Bucks County, Chester County, Pennsylvania, or anywhere in New Jersey, contact me today and set up a free consultation of your DUI expungement case.

Why Would You Want to Get a DUI Expunged?

In the state of Pennsylvania, a DUI conviction can stay on your record for life, unless you get it expunged. There are many benefits of having a DUI arrest or conviction removed from your driving record. As stated before, a DUI conviction can affect many aspects of your day-to-day life, including the loss of your driver’s license or other professional licenses, higher auto insurance rates, loss of job opportunities, a more difficult time finding housing, and more. With an expunged record, those doors, while maybe not all at once, can start to open again, giving you access to lower insurance rates, a reinstated license, job and housing opportunities, and more. Are you ready to get your life and career back on track? Tell me the details of your case by contacting me at The Law Offices of John Della Rocca.

Who Is Eligible for a DUI Expungement?

Many factors can affect your eligibility for a DUI expungement in the state of Pennsylvania. If any of the following scenarios relate to your situation below, contact me immediately, and let’s get started on your DUI expungement:

  • You were not convicted of the DUI – If you were arrested for a DUI and there are no proceedings currently against you, as long as 18 months have passed, you may be eligible for an expungement.

  • Resolution through an ARD program – After successfully completing an Accelerative Rehabilitative Disposition program relating to the crime you were accused of, you may be eligible for an expungement. Want to learn more about ARDs? Contact me and I can help you.

  • Age time limits – If you were at least 18 years old, but not yet 21, and have completed all of the requirements for your conviction, you might be able to clear it from your record.

No matter what your circumstances are, I want to help you clear your name. If you have been arrested or convicted of a DUI in Philadelphia, Delaware County, Montgomery County, Bucks County, Chester County, Pennsylvania, or New Jersey, contact me for a free case consultation.

The Pennsylvania Expungement Process

The process of getting an expungement is not as difficult as it sounds, especially when you have an experienced criminal defense attorney representing you. The process is as follows:

  • I will prepare and file an expungement petition in the county where your DUI charge occurred.

  • The petition is then filed in the County of Record and the District Attorney has 30 days to either consent, reject, or ask for a hearing.

  • If accepted, a judge will then sign the expungement order and all records relating to the crime will be destroyed.

  • The Pennsylvania State Police will then update their database.
